Title transfers

Title transfers: Adding or removing people from property titles.

Transfer property titles with ease.

For whatever reason a property is to be transferred:

  • Gifting it to a family member or partner
  • By court order, financial or marriage arrangement
  • Deceased estate
  • Or a sale following a title transfer

We can do it all.

A transfer of title is the same as a transfer of your interest on a title, whether it be the whole title, or just a portion of it. In both cases, the conveyancing requirements and considerations are also the same.

How we help

Determine the type of transfer

  • Tell us about your specific situation: the type of property, the purpose of the transfer, if any banks are involved and what is being transferred to and from whom.
  • We can then give advice on how to proceed, and who we should get involved to make sure everything is accounted for and the process runs smoothly.
  • We also recommend that you discuss with your accountant or tax advisor prior to commencing a title transfer as there may be tax implications.

Completing the paperwork for the transfer

  • Once we have established the plan of action, we action it.
  • We coordinate information between banks, government departments, council and utility providers in preparation for the transfer.
  • You will be informed at every step of the way, including any stamp duty implications.
  • We then lodge all documents on your behalf to make sure all requirements are met and the title is transferred seamlessly.

Frequently asked questions

Stamp duty is exempted if you are transferring your principle place of residence to your partner/spouse. If you are transferring the property to your child/parent/relatives, stamp duty is calculated based on the higher of property market value or any consideration paid. If the transfer to a former partner/ex-spouse is due to a breakdown of relationship, duty is exempted (different Australian states vary).

There are additional settlement fees associated with a transfer transaction. For example, third party fees such as lodgement with the Land Titles Office, PEXA service fees, stamp duty and any bank fees.
If there is no bank involved, usually the transfer will be completed in around 2 weeks. However, this depends upon the complexity of the transaction. If there is a bank involved, this will depend on the processing times of the bank. Please note that each bank will have different processing times.
