Property Lawyer Melbourne
Tips for buying and selling a property in Victoria.
Tips for Purchasers
Get a contract review
Make sure you have the contract of sale reviewed before you sign. Your conveyancer or lawyer can advise you on contractual terms, conditions, and things to consider/look out for regarding property details in the Section 32.
Cooling Off Period
Where there has been a change their mind about the property purchased, you have three clear business days from the day you sign to cool off. Note that the cooling-off period is not available for properties bought at auction.
Inspect the Property
You may conduct an inspection of the property (i) before signing the contract and (ii) before the settlement day to check the property is in the same condition as the day it was purchased. The property is to be handed over to you in the same condition as the day of sale.
Tips for Vendors
Be contract ready
Selling property are exciting times. It is important that you appoint a lawyer or conveyancer that has your contract and vendor statement (section 32) ready for you to take offers from prospective purchasers.
Appoint a conveyancer or lawyer
Your conveyancer or lawyer will prepare your contract of sale/ vendor statement (section 32) and ensure that your comply with your vendor disclosure requirements. Finding the right conveyancer and lawyer will ensure the transaction goes seamlessly.
Get early release of your deposit
Early access to your deposit could be handy, particularly if you are looking to purchase another property. Speak to your lawyer or conveyancer to see how early release of the deposit can be arranged. It can take up to 28 days before the deposit is released.
